Justice Margaret Mutonyi has acquitted Abubaker Kalungi for the double murders of former Buyende District Police Boss, ASP Muhammad Kirumira and Resty Nalinya Mbabazi. Justice Mutonyi said that the prosecution failed to prove Kalungi’s participation in the murders.
Kirumira and Nalinya were gunned down by two motorcyclists while they sat in Kirumira’s car on September 8th, 2018 in Bulenga, Wakiso District.
Kalungi was arrested from the Buliisa district in September 2018 and charged with the murders along with Hamza Mwebe.
According to the prosecution, Kalungi was allegedly hired by Hamza Mwebe and Abdu Kateregga to trail Kirumira and inform them of his whereabouts.
Mwebe was acquitted by court in December 2022 while Katerega was killed in Namungoona, Kampala by security agents and thus Kalungi was the only suspect left in the case. Kalungi has however denied involvement in the murder insisting that on the day of the shootings, he was roofing a house in Ndejje Kibutika and retired to his home after work.
According to Justice Mutonyi, the prosecution failed to prove participation of the suspect in the murder where it had to prove beyond reasonable doubt that the accused person had directly participated in the murders by placing him at the scene of the crime or indirectly facilitating the matter.
The court session was attended by the family of Kalungi and that of the late Kirumira.
