The Entebbe Chief Magistrates Court upheld a January 2025 Criminal Court ruling, sentencing four men to prison after convicting them of attempting to murder Nankya Enfrance of Lyamutundwe in Katabi town council, Wakiso district who is currently receiving treatment in the United States of America.
The Court declared the defendants guilty of complicity in attempted murder on 4th June 2023, following the evidence provided.
All were sentenced on Wednesday, 15th January 2025: Alex Male Lukeera to 25 years imprisonment, Yassin Lubwama to 20 years imprisonment, Richard Musiime to 10 years imprisonment after being guilty following the trial, and finally, Kayiwa Ssali to 3 years of imprisonment after knowing what is going to happen but around pretending to fetch water.
The Entebbe Chief Magistrate, Stella Maris Amabilis highlighted that following court evidence, on 4th June 2023 at around 11: 00am, Lubwama went to Nankya’s home asking for space to make chapart, and Nankya’s evidence that she told him that a person responsible is not around, however, he decided to seat on the veranda and kept on rotating around. She further testified that during that interaction, her daughter (Christine Nabukenya) came back from work, and she informed her about the space Lubwama wanted.
Both Nankya and Nabukenya testify that Lubwama went with Nabukenya to see the space for chapart making, but after some time, as Nankya was entering the house, Lubwama cut her three times on the neck horizontally, however in the process she held the knife, which also cut her fingers at around 4: 00 pm.
It’s also with court evidence that Musiime was communicating with Lubwama, saying that “today it must be done.”
According to the court, the evidence of both Nankya and Nabukenya collaborated with that of the doctor, who, in his evidence, confirmed that there were three cuts around the neck caused by a sharp penetrating force consisting of a knife.
The court revealed that Kayiwa learned about what would happen and kept quiet. It was also because of Lukeera that Musiime hired Lubwama to help him kill the victim, but their plan was unsuccessful.
Therefore, the state prosecution requested the court not to allow the accused at any time to interact with the community because they are so dangerous to human life and requested to be sentenced to life imprisonment; however, the counsel for the accused asked for a lenient sentence based on their responsibilities and being merciful to court.
The Chief Magistrates made the ruling, saying, “The convicts all deserve the sentence that will not enable them back to the community because they almost took the life of an innocent and helpless person who, up to date, is still undergoing treatment in the United States of America.”
In conclusion, her worship Amabilis noted that they all have a right to appeal against acceptance of the sentence.
